Dane-Elec product warranty conditions
Dane-Elec Memory, hereinafter referred to as, “Dane-Elec”, warrantees that its products are exempt of defects and/or vices in relation to materials as well as manufacturing.
The warranty will only be applicable when these products are used with appropriate devices and in conformity to standards that are in effect. This warranty is solely reserved for the purchaser of the products upon presentation of proof of purchase. This warranty is null and void if the products are not subject to normal use or if Dane-Elec determines that the failure was caused by negligence, abnormal use, improper installation, repair, alteration or a . Dane-Elec declines all responsibility in case of failure or defect caused by a third party product or element of any kind.
Dane-Elec’s products are destined only to final users and are not designed nor warranteed for commercial use. If a product becomes defective under the terms of this warranty, Dane-Elec will examine the said product and, at its sole discretion, will proceed with repairing or replacing the product. Dane-Elec will then ship a product of equal or superior capacity, in terms of performance. Dane-Elec’s sole responsibility and exclusive recourse, in reference to the acknowledged defect(s), will be to repair or replace the said product. Dane-Elec may, at its sole discretion, replace the said product with a refurbished unit.
DANE-ELEC WILL BE HELD HARMLESS UNDER ALL CIRCUMSTANCES, FROM INDIRECT DAMAGES, ACCESSORY, CONSEQUENTIAL OR LOSS OF INFORMATION OR DATA.

The Zpen by Dane-Elec hereafter is covered by this warranty for a period of one (1) year, parts and labor, commencing upon the date of purchase from the store.
The accessories (for example and without this list being exhaustive: headphones, USB, …) are covered by this warranty for period of 15 working days commencing upon the date of purchase from the store.

This warranty only covers the repair or the replacement of the defective Zpen product by Dane-Elec. Dane-Elect renounces all responsibility for all relative costs for maintaining and/or installing and/or removing the Zpen product by Dane-Elec, which are all excluded from the warranty framework. Dane-Elec commits to provide ongoing support for its products, and to not render them obsolete, as long as adequate parts are available on the market and a reasonable customer demand exists for these products.

To have a product repaired under warranty, the defective product must be shipped (shipping and insurance fees/expenses are at shipper’s expense) to the supplier, reseller or certified Dane-Elec distributor from whom the Dane-Elec product was purchased. All pertinent information in order to identify the product, notably reference to the model and serial number (when applicable), as well as a detailed description of the encountered problem MUST BE enclosed. The proof of purchase of the product containing the purchase date justifying that the defective product is covered by the warranty must also be enclosed.
In the case whereby the supplier, reseller or Dane-Elec distributor has closed, and only in this case, the defective product may be sent by courier or certified mail directly to Dane-Elec, as long as an "RMA" return material authorization number was obtained directly from Dane-Elec. Once a Dane-Elec RMA number has been obtained, the defective product must be shipped with the proof of purchase, indicating the date of purchase justifying that the product is covered under warranty, by courier or certified mail within eight (8) working days; the way bill or postmark confirming such, with shipping and insurance fees at the shipper’s expense.
According to the country in which the product was purchased, the elements must be addressed using the address indicated in the RMA agreement.
The product shipped by courier or certified mail directly to Dane-Elec must be properly wrapped and packaged in order avoid damage during the return shipping. The Dane-Elec RMA number must be clearly visible and identified on the exterior of the packaging. Absolutely no return without the mention of the RMA number being clearly visible and identified on the exterior of the packaging will be accepted.

Dane-Elec reserves the right to refuse acceptance of a defective product for repair if:
- Malfunctions resulting from not following all instructions mentioned in the user manual or the quick start guide, notably from receiving abrupt shocks or removing the second transparent film protector from the drive which therefore no longer protects it from scratches (the first transparent film protector held by a white tab must be removed before use).- Malfunctions resulting from negligence or abnormal use from installation, storage and/or use of the product in an inadequate environment.- Malfunctions resulting from damage or intentional negligence.- Malfunctions that are a consequence of repairs carried out other than by a certified Dane-Elec service center.- Malfunctions which are caused by components, software or material not installed by Dane-Elect.- Malfunctions caused by a virus and/or spyware.

DANE-ELEC WILL NOT, UNDER ANY CIRCUMSTANCES, BE HELD RESPONSIBLE, WITH RESPECT TO AN END-USER OR A THIRD PARTY, FOR ANY/ALL DAMAGES INCLUDING SPECIFICALLY, BUT NOT LIMITED TO: THE DIRECT OR INDIRECT LOSS OF SOFTWARE, SPECIAL HARDWARE, ELS OR RELATED, FORSEEABLE OR NOT, RESULTING IN THE NULLIFYING OF THE WARRANTY, OR THE CONTRACT, OR FROM NEGLIGENCE RELATED TO THE SALE OF THE PRODUCT, EVEN IF DANE-ELEC OR ITS AFFILIATES WERE NOTIFIED OF THE POSSIBILITY OF SUCH PREJUDICE.
THE INFORMATION ABOVE REPRESENTS THE ENTIRETY OF THE WARRANTY OFFERED BY DANE-ELEC FOR ITS PRODUCTS AND SUPERCEDES AND REPLACES ALL OTHER WARRANTIES OR DECLARATIONS, INCLUDING VERBAL OR WRITTEN, EXCEPT IN THE SPECIFIC CONDITIONS LISTED BELOW, NO OTHER WARRANTY IS GIVEN REGARDING THE DANE-ELEC PRODUCTS AND DANE-ELEC DECLINES ALL RESPONSIBILITY NOT EXPRESSLY DESCRIBED HEREIN, INCLUDING, ALL IMPLICIT WARRANTIES OF MERCHANTABILITY OF DANE-ELEC’S PRODUCTS OR ADEQUATION OF A SPECIFIC USE WITHIN THE LIMITS PRESCRIBED BY LAW. DANE-ELEC DECLINES ALL RESPONSIBILITY WITH THE PURCHASER OR USER OF A DANE-ELEC PRODUCT REGARDING MATTERS OF INCURRED PREJUDICE, REGARDLESS OF WHAT THEY ARE, NOTABLY ALL DAMAGES AND INTERESTS, EXPENSES, LOSS OF SALES, LOSS OF PROFITS, PECUNIARY LOSSES OR ALL OTHER INDIRECT OR ACCESSORY PREJUDICE RESULTING FROM THE PURCHASE, USE OR THE IMPOSSIBILITY OF USE OF THE DANE-ELEC PRODUCT, EVEN IF DANE-ELEC HAD BEEN NOTIFIED.
The responsibility of Dane-Elec will not be invoked in case of a shortcoming, failure or delay in performance resulting from a cause beyond its control. Dane-Elec will be held harmless from independent events of its goodwill which prohibits assuring the conditions of the proposed warranties.
Dane-Elec reserves the right to transmit your information to third parties and this, in order to ensure the completion of the service.
All previous revisions of terms and conditions will be superseded and replaced by the latest revisions of the Warranty document. The latest or current revisions of the Dane-Elec product Warranty document will constitute the applicable document to which you will be legally bound. The Exclusions of the Dane-Elec warranty do not in any way infringe on the legal rights of the customer.
